Terms of Service

Part A — General terms (all customers)

1. Seller and scope

These terms apply to all orders placed on lid-o.com. The seller is CREATIVENORM, LLC., 501 NE 31st Street, Suite 2104, Miami, FL 33137, USA (info@lid-o.com), referred to below as "we" or "Lid-O". Part A applies to every order. Part B also applies if your shipping address is in the United States. Part C also applies if your shipping address is in Europe (EU/EEA, Switzerland or the United Kingdom). If Part B or Part C differs from Part A, Part B or Part C takes precedence.

2. Contract

The product pages on our site are not binding offers. When you place an order, you make a binding offer to buy. The automatic order confirmation only confirms that we have received your order. A contract is concluded when we accept your order by shipping the goods or by sending a shipping confirmation. The contract language is English or German.

3. Prices and payment

All prices are final prices and include all applicable taxes. Any shipping costs are shown before you complete checkout; see our Shipping Policy. For deliveries outside the US and Europe, the recipient may have to pay import duties. You can pay with the payment methods offered at checkout.

4. Delivery

We deliver to the shipping address you provide. Delivery areas, delivery times and shipping costs are set out in our Shipping Policy. If an item is not available, we will let you know straight away and refund any payment you have already made.

5. Retention of title

The goods remain our property until they have been paid for in full.

6. Returns

You can return products within 14 days of delivery. You pay the cost of return shipping, unless the item arrived damaged or we sent the wrong item. Full details are in our Returns & Right of Withdrawal policy.

7. Intellectual property

LID-O and MYLIDO are trademarks of CREATIVENORM, LLC. The Lid-O lid is protected by US Patent 12,240,655 B2. You may not use the content of this website, including texts, images, videos and designs, without our permission.

Part B — Customers in the United States

B1. Warranty

If your Lid-O arrives damaged or defective, email info@lid-o.com with a photo within 30 days of delivery and we will send a replacement or refund you in full. Except for this promise and any warranty that cannot be excluded by law, our products are provided "as is" and we disclaim all other warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose, to the extent permitted by law. Some states do not allow these exclusions, so they may not apply to you.

B2. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to an order is limited to the amount you paid for that order. This does not limit liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot be limited by law.

B3. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Before filing a claim, please contact us at info@lid-o.com so we can try to resolve the issue informally within 30 days. Any dispute that cannot be resolved this way will be brought in the state or federal courts located in Miami-Dade County, Florida, except that either party may bring an individual claim in small claims court where it qualifies.

Part C — Customers in Europe

C1. Right of withdrawal

Consumers have a statutory 14-day right of withdrawal. The withdrawal notice and the model withdrawal form are in our Returns & Right of Withdrawal policy. You bear the direct cost of returning the goods.

C2. Warranty

The statutory warranty rights apply (generally two years from delivery). If a product is defective, please contact info@lid-o.com.

C3. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence, we are only liable for breaches of essential contractual obligations, and only up to the damage that is typical and foreseeable for this kind of contract. Mandatory statutory liability, including product liability, remains unaffected.

C4. Applicable law and disputes

These terms are governed by the laws of the State of Florida, USA, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, you keep the protection of the mandatory provisions of the law of the country where you normally live, and you may bring proceedings in the courts of that country. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
